1. Introduction & Acceptance of Terms

Welcome to Boombox Rap AI ("Boombox Rap AI" / "we" / "us" / "our"), an individual / sole trader operating under the laws of the People's Republic of China. These Terms of Service ("Terms") govern your access to and use of our AI-powered entertainment video service that helps users create short street-rap style clips from photos they upload, available at https://boombox-rap-ai.pages.dev (the "Service").

By creating an account, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; (d) agree to our Acceptable Use Policy; and (e) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Service Description

2.1 What We Provide

Boombox Rap AI provides an AI-powered platform that enables users to upload two photos and optional lyrics or style preferences to generate short entertainment videos in a viral boombox / street-rap format. The Service is a digital software-as-a-service (SaaS) product delivered via the internet.

2.2 Nature of the Service

The Service is a digital, intangible product. Upon confirmed payment, credits are granted for use in the Service. Due to the immediate digital delivery of credits and generated media, specific limitations apply to refunds as described in Section 7.

2.3 AI Model Dependency

Our Service may utilize third-party AI model providers (for example via fal.ai endpoints such as MiniMax H3 and planned reference-to-video models). Service performance and availability may be affected by the operational status of these providers. We do not claim that outputs are verified for a specific generation speed or likeness quality. Outputs are AI-generated entertainment content.

2.4 Photo & consent requirements

You may only upload photos of yourself or of adults (18+) for whom you have obtained written permission. You must not upload photos of minors, celebrities for impersonation, or anyone who has not consented. The Service is not a tool for unauthorized likeness use.

3. Account Registration & Eligibility

3.1 Account Creation

To use certain features of the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3.2 Account Security

  • Do not share your credentials with any third party.
  • Keep your billing email address up to date.

3.3 Business Accounts

If you register on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Credits & Top-up Plans (one-time packs)

The Service operates on a credit-based system. Users may purchase one-time credit packages (Try, Starter, Creator, Pro) at any time. Credits are spent to generate videos. For current packages, prices, and included credits, please visit Pricing. There is no subscription and no automatic renewal.

5. Billing & Payment

5.1 Single Purchase Authorization

Each credit purchase is a one-time transaction. By completing a purchase, you authorize us to charge your payment method for the amount displayed at checkout. Card and payment data are processed by our PCI-DSS certified payment processor, Waffo Pancake, and are not stored on our servers.

5.2 No Auto Top-up

We do not currently offer automatic top-up. Enabling any future auto top-up would require your explicit opt-in and could be disabled at any time.

5.3 Taxes

Prices are exclusive of applicable taxes unless otherwise stated. Where required by law, applicable taxes will be collected at checkout.

6. Credits Validity & Account Termination

6.1 Credits Validity

Purchased credits are valid for 365 days from the date of purchase, unless otherwise stated at the time of purchase. We may send a reminder before credits expire when email delivery is available.

6.2 Termination of Account

If your account is terminated (by you or by us), unused credits will be retained for 30 days following termination. After this period, unused credits expire without refund unless otherwise required by applicable law.

7. Refund Policy

All credit purchases are generally non-refundable after credits have been consumed. The following exceptions apply:

  • Unused credits within 7 days of purchase: A full refund may be requested within 7 days of purchase if no credits from that purchase have been used.
  • Duplicate charge: Full refund for any billing error resulting in a duplicate charge.
  • Statutory rights (EU/UK/AU and similar): Where a 14-day withdrawal right applies for first-time digital purchases, those rights are preserved and are waived upon first use of the purchased credits as permitted by law.

To request a refund, contact darkerchen159631@gmail.com with your account email, transaction ID, and reason. We will acknowledge within 2 business days and process eligible refunds within 5–10 business days.

8. Billing Disputes

If you believe there is an error in a charge, please contact us at darkerchen159631@gmail.com before disputing with your bank. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

9. AI Output & Intellectual Property

9.1 Ownership of Outputs

Subject to these Terms and the Acceptable Use Policy, AI-generated content produced in response to your inputs ("Outputs") is owned by you. You may use Outputs for lawful entertainment and personal or commercial purposes consistent with Section 10 and the AUP.

9.2 Input License

By submitting content to the Service ("Inputs"), including photos and lyrics, you grant Boombox Rap AI a limited, non-exclusive license to process your Inputs solely to deliver the Service. We do not use your Inputs to train AI models without your explicit consent.

9.3 Third-party AI Model Dependency

Our Service uses third-party AI model providers. Outputs may be influenced by these providers' models. We do not guarantee specific output quality and accept no liability for outputs generated by third-party models.

9.4 Accuracy of AI Outputs

AI-generated content may contain errors, unexpected artifacts, or inaccuracies. You are solely responsible for reviewing Outputs before posting or relying on them.

10. Acceptable Use Policy

You may use the Service only for lawful purposes. The full content standards, prohibited categories, reporting channels, and enforcement actions are set out in our standalone Acceptable Use Policy, which forms part of these Terms.

Without limiting the AUP, you agree NOT to use the Service to:

  • Generate content that is illegal, defamatory, harassing, or fraudulent.
  • Create unauthorized likeness content, impersonation, or deceptive synthetic media involving real people who did not consent — including celebrity spoofs and intimate-scene compositing.
  • Generate content that sexualizes minors or violates child protection laws.
  • Produce malware, phishing content, or cyberattack tools.
  • Infringe the intellectual property or privacy rights of any third party.
  • Circumvent or interfere with security features of the Service.
  • Resell or sub-license access to the Service without prior written approval.
  • Violate any applicable law, regulation, or card network rule.

11. Data, Privacy & Security

Your use of the Service is governed by our Privacy Policy. Payment card data is processed exclusively by our PCI-DSS certified payment processor (Waffo Pancake) and is not stored on our servers. Account data is retained for 90 days following cancellation, then deleted, subject to legal retention requirements for transaction records.

12. Disclaimers & Limitation of Liability

12.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUTS.

12.2 AI-Generated Content Disclaimer

Outputs may be inaccurate, incomplete, or unexpected. Do not rely on them for legal, medical, financial, or other professional advice. Always review AI-generated content before publishing.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOMBOX RAP AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Term & Termination

These Terms remain effective while you use the Service. We may suspend or terminate your account if you materially breach these Terms or the AUP, we suspect fraudulent activity, or as required by law. If we terminate for reasons other than your breach, we will provide a refund for unused prepaid credits where required. 14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles, except where mandatory consumer protections in your country of residence apply. Before initiating any formal proceedings, please contact us at darkerchen159631@gmail.com to attempt informal resolution.

15. General Provisions

We may update these Terms at any time. Material changes will be notified by email (when we have your address) at least 14 days before the effective date, and by updating the Last Updated date on this page. Continued use constitutes acceptance. If any provision is found unenforceable, the remainder continues in full effect.
